Mistrial Looming in Anthony Pellicano Trial

The trial of former Hollywood private investigator Anthony Pellicano on illegal wiretapping charges was just about to wind up. But the Government today decided to call a rebuttal witness to impeach the credibility of former police sergeant Mark Arneson, one of Pellicano's co-defendants, and it blew up in their face. The witness may now be charged with a crime and the Judge is considering a mistrial.

    If the prosecution did such a lousy job vetting their own witness, you have to wonder how good the rest of their investigation was.

    I'm surprised that the judge didn't call for a mistrial after at least one of the jurors heard the prosecutor call out that he was going to charge one of the witnesses with perjury while the jurors were still heading out the door.

    There's so much reversible error I think - at least by reading the coverage on HuffPo which has been entertaining to say the least.
