Nigerian Court Orders Public Horsewhipping for 4 Gay Youths

A Sharia court in Bauchi City, Nigeria sentenced four young men to 15 lashes with a horsewhip for having gay sex. The floggings were conducted publicly in the courtroom after trial and sentencing at a secret hearing. In addition, the youths were order to pay a fine, and if they can't afford it, they will have to spend a year in jail.

[A Human Rights activist] said the men, aged between 20 and 22, should not have been convicted because their confessions had been forced by law agents who beat them. She said they had to prostrate themselves on the floor of the court to be whipped on their backsides.

In January, Nigeria’s President Goodluck Jonathan signed a bill into law banning gay marriage and same-sex unions. It also reinforced criminal penalties for homosexuality and granted federal support to the Sharia authorities to enforce anti-gay laws. [More...]

There has a been a wave of arrests since then. One youth was flogged with 20 lashes days after the law passed. The alleged act occurred 7 years ago.

Judge Nuhu Mohammed said he would spare Ibrahim the sentence of death by stoning because the crime occurred so many years ago and because the young man had shown “great remorse.”

The hearing for those flogged yesterday was initially set for January but postponed when thousands of Nigerians descended on the court urging the defendants be executed. Judges in Sharia courts have the discretion to order death by stoning for sodomy.

The Islamic justice system, which runs parallel to state and federal courts in northern states, provides for death by stoning for sodomy once it is established by four witnesses to the act or by voluntary confession.

Hearings for four more men are pending. One Christian who was arrested had his case sent to the secular court. As to those punished yesterday:

Judge El-Yakub Aliyu ruled that because the men were not caught in the act, there was no legal basis for passing the death sentence, despite confessions by two of the defendants.

"The judge said although two of the men admitted to having engaged in sodomy four years ago, there was no basis to give them the death sentence since they told the court they have repented and it would be unjustifiable to sentence them in retrospect," said Mr Mohammed.

    has swung into action calling on world leaders to not only condemn, but also, use all their powers to end this oppression.  President Obama has responded by freezing the assets of Nigerians, canceling visas and implementing sanctions by executive order.

    Senators Lindsey Graham (R. SC) and John McCain (R. AZJ) have faulted the president for not acting more quickly, given that the situation has existed for days.  Senator Graham shouted that Congress is frustrated that the Administration has not called for repeal of the Nigerian law and has not given a sternly worded warning that President Goodluck Jonathan will become a pariah among nations.

    In a show of ecumenical unity, the Pope, Pope emeritus, and the President of the World Council of Churches have called for a global day of prayer to free all Nigerians to live their lives in dignity and with love.

    Arizona governor Jan Brewer heralded the national and international action.  Moreover, the governor expressed her hope that Nigeria would realize that this is bad for business.

     The world-wide clamor for justice was not unanimous, however.  The Arizona legislature agreed with President Goodluck proclaiming that Nigeria is on the right track--the next thing, they advised, is that Nigerians will be forced to bake for homosexuals.  ;)

    like we should be against Sharia law, not supporting groups that promote it.

    Not sure Nigeria and law should be in the same sentence.

    Texaco, back when she handled international taxes.  They were ushered about in armored limousine convoys.  I was glad when she left that gig behind.

    They're fighting over huge amounts of natural resources.  A cynic would wonder if this isn't just another intentional distraction, to make stealing by the well connected easier.

    I like that idea...  although capitalism works best when things are stable.... calling attention to the country, even as a distraction, is still unwanted attention to those who are getting rich by exploiting Nigeria's natural resources.

    Nigeria is a country that is 40% Christian and 50% Muslim.  Both populations are very conservative and support these laws against homosexuality.

    The problem isn't just "Shariah law" ... it's religious conservatives in general, including those from the US that promote bigoted, draconian laws against homosexuality in Africa.

    BTW - "Conservatives in the US" did far more than "refuse to bake a cake".  They actually spoke out in favor of the anti-homosexuality laws in Africa and even helped write those laws.  When did Putin support the anti-homosexual/death penalty laws in Africa?

    Anyone who thinks Putin is a "left-wing socialist" is living in a fantasy world.  His political affiliation/ party is United Russia, a right-wing party that self-identifies as the "Russian conservative" party.

    ... "Nigeria" and "oil" ARE in the same sentence. The country is the eighth largest oil producer in the world, and exports 43% of its product to the United States.

    Hopefully, given that Nigeria is disproportionately reliant upon oil for its revenues, which comprise 95% of its overall exports, we can use that as leverage to bring about change in its behavior regarding human rights.

    You got a problem with that? Makes perfect sense to me. In fact, it sounds like it could have come straight out of the CPAC meeting just concluded. (lol)

    In fact, it looks and sounds exactly like any of the whack-job, gibberish they spew as undisputed, irrefutable "fact." For instance, "the earth is 6000 years old." We have long had scientific ways to measure the age of trees, and, many trees have been determined to be many times that age. When offered that unquestionable evidence do they say, "oops, maybe we miscalculated a  little bit?" Of course not. They are completely satisfied with their long held, nonsensical opinion, show no sign, whatsoever, of modifying their stance, even when it's proven to be erroneous, and, retort with something like, "well, we'll just have to wait and see, science has been shown to be wrong before, you know."

    And, then they strut away, convinced that they just "showed you up, but good," and, further reinforced by the waves of approving applause their equally delusional supporters provide.

    A Clown Show you really have to see to believe.
