Sen. Larry Craig Hearing Set for Sept. 26

Blogger Beldar just got off the phone with the Hennepin, County Court Clerk. He was trying to find out if there was a Form 11 in the file showing Craig had been advised of and waived his right to counsel.

The Clerk said she didn't see one and told Beldar a hearing has been set for September 26th at 1:30 pm on Craig's motion to withdraw the plea.

Good work, Beldar. For anyone who hasn't read the motion yet, here it is (pdf), with exhibits. There's also a lively discussion by several lawyers in the comments here.

    legal eagles planning on attending? it's either going to be high drama, or high camp. i don't think there can possibly be a happy medium with this.

    I don't have anything on my calendar right now for that day.  Is the hearing in Minneapolis or at the Southdale Court ( a satellite court in a suburbs where the plea was entered)?

    I spoke yesterday with Pat Hogan, the director of public affairs for the Minneapolis-St. Paul Metropolitan Airports Commission, who advised (among other things) that the hearing is supposed to be in Courtroom 227. But I don't know which location that corresponds to, sorry.

    227 is probably at the Southdale Court.

    This WaPo article says, "The Hennepin County District Court said the hearing will be held in Edina, a Minneapolis suburb."

    Jeralyn, I've obtained (and linked from a new post on my own blog) a copy of prosecutor Renz' July 20th letter to Sen. Craig, under cover of which Renz sent the draft motion to enter a guilty plea. It contains a number of reminders/implicit suggestions that Craig is entitled to consult with counsel. It contains a blunt warning that if Craig goes through with the plea, it would result in a conviction for disorderly conduct appearing on his criminal record.

    I'm reasonably sure that the prosecution will seek to offer it at the September 26th hearing. It arguably cures, or at least ends any possible argument of prejudice from, the Rule 15.02 violation, and it's very inconsistent with Craig's "I panicked, and so I took the deal because they promised me it would be secret" approach. But you may have a different reaction altogether than the one I had, so I'll keep checking back.  Thanks again for the opportunity to comment here — I've enjoyed the interchange of ideas!
