Thursday Open Thread

I've been an absent blogger this month. I have been busy at work, not too interested in domestic news, and planning my first international trip since 2008 - well before COVID.

With the whole world my oyster, where did I pick? Istanbul for a week in September. In another post I'll explain why, but I'm ticketed, I have my pre-TSA pass and I am very excited about it.(Also, some friends of mine have provided me their condo to stay at on the Asian side, which is the side I want to stay at).

Has anyone seen the plans for "The Line", (the vertical glass city Saudi Arabia thinks will be the future of the world in 2030? It is 180 degrees
from what Istanbul, London, New York, Shanghai and other large cities offer. I find the homogeneity of the planned city dwellings depressing. Actually, I think the whole concept is depressing, even the mountains they are building.

    Sandmann had sued NBC, CNN, ABC, CBS, The New York Times, The Washington Post, and Gannett. NBC, CNN, and the Post settled with Sandmann. The rest just prevailed on summary judgment.

    You can tell by reading the language you quoted from the article.  Of course, sometimes it's less expensive to settle than pay legal expenses.

    They're no no "legal punishments" for anyone (including the media outlets) because they did nothing wrong.  You have to establish that someone committed a crime before they are subject to "legal punishments".  No one established ANY wrongdoing in this case, criminal it civil.  Surprising that someone who claims to be a strong proponent of "innocent until proven guilty" wouldn't know this.

    I now see I had originally misread the article I quoted and Sandmann also collected something from NBC and CNN besides the Post.  I hope somebody familiar with such cases could hazard a guess as to his total take.  As much as a 4 year, all expenses paid, college scholarship?

    But if you're interested in a "guess", you might as well go with an educated guess.  Given the fact that it settled before the plaintiff was even deposed and a ballpark cost of $200,000 just to get through discovery to summary judgment, nuisance value is probably in the $50,000 range.  Of course, once you factor in the fee and expenses for Lin Woods (LOL!), Sandmann would be lucky if he could pay for a semester at Liberty U - more likely whatever his books and fees cost for a semester.  All of which is @ $50,000 too much, but that's the kind of decisions insurance carriers make no matter how meritless a claim may be.

    keynote speech at a Notre Dame Conference on religious liberty, in Rome, in which he mocked "foreign leaders" who condemned his opinion overturning Roe V Wade, including Boris Johnson, Macron, and Trudeau.  He was especially belittling of Prince Harry.

    For the Tory, Boris Johnson, Alito "quipped", but "he paid the price".  A real knee slapper.  

    The link (scroll to the bottom of the article) records the Alito address (you may not recognize him with his new mustachio look). This Supreme Cleric is a sore winner smarting under criticism of his awful opinion.

    Of course, then there is the photo-op of the candidate Herschel Walker and Clarence Thomas at a DC awards ceremony.  No, not political hacks, claims Amy Barrett.

     

    ... thin-skinned. Personally, I find that people who are smug and self-absorbed a$$holes at heart tend to be so.

    With Dobbs, Alito wielded his Catholicism on the Supreme Court as a weapon of mass destruction, seriously tarnishing and degrading the Court's public credibility and undermining its moral authority in the process. But that clearly doesn't matter to him, particularly last night as he worked the room at Notre Dame for laughs.

    History will likely not be very kind to Sammy Alito. The best he can hope for from history's verdict is that he will one day recede into anonymity as those who remember and experience the practical impact of Dobbs eventually pass from the scene over the coming decades.

    After all, few people today - save perhaps for legal scholars and historians - remember Henry B. Brown, the justice who authored the high court's decision in Plessy v. Ferguson, 163 U.S. 537 (1896). But the country certainly had to live with and endure the fallout from his handiwork for about seven decades.

    someone who was born old and mean. Don't know if a mentor of his, Maryanne Trump Barry, TFG's sister, had any further influence on his disposition. (Trump Barry was his supervisor when he was an assistant US attorney, and was among those who recommended him to a federal judgeship on the Third Circuit, where they then served together).  

    We are still waiting to find out about that Holy Heist wherein the Alito draft opinion was leaked. The Chief Justice was very mad about that and Republicans called it a "dangerous attack" that required criminal prosecution. That, of course, was when they thought the leaker was a clerk for Kagan, Sotomayor or Breyer.  My guess it was not any clerk, especially not one of the conservative clerks--who are likely to be among the world's best boys and girls.

    Current thinking seems to be someone who wanted to lock-in the Alito opinion in the face of reporting that Roberts was pressuring Kavanaugh to join him in his preferred frog boiling of Roe, rather than a flat-out over-turning. I continue to like Ginni as the leaker (via Clarence), but I could be persuaded that it was Alito himself.

    but my impression is that there is nothing in the decision or precedents that indicates the SCOTUS would vote to overturn an abortion rights bill that were to get past a Senate filibuster and signed into law.

    was about whether or not passage of a bill like the WHPA could possibly be undone by the Supreme Court, not whether or not it could get through the Senate.  I can't imagine a constitutional objection to it besides some weird reading of the 10th amendment.

    Seeing doctors and getting every test available.
    I had a small breast cancer tumor, and my surgery was Thursday.  They removed the tumor (via lumpectomy) and nearby lymph nodes.
    After we see the results of the pathology report, as well as the genetic testing, the treatment will be finalized.
    I'm just glad the surgery is over.  (And that I get a mammogram every year, so the cancer was found very early.)

    conducted at its Dallas Nazi-knock off meeting, showed that 69% of attendees favored TFG to be the Republican presidential candidate in 2024.  The group looked toward Noem (9%) and Pompeo (7%) for his running mate.  TFG's percentages are on the rise since their conference in Orlando  last February when it was 59%.

    Apparently, the mounting evidence  of Trump's criminality, insurrection leadership and grifting are clinching the deal for these   Republicans.  All the more for Red Caps to love.

    What about poor DeSantis?   While still CPAC's second choice, he now stands at 24%, down from his 28% in February. He needs more ideas on how to out-fascist TFG.  Burning books, demonizing gays, mocking and discounting public heath are just not enough. He needs to step-up his game.

    A tutorial in the fine points of fascism by Victor Orban would be good.  Some further  tips:  work on his unfortunate squat appearance, wear suits tailored with a Trumpian muumuu look, lose  the school-boy haircut, and lay off inhalation of helium or whatever he needs to do to get away from that 13-year old boy voice.  Probably not much he can do about his charmlessness, but he should try to smile every now and then, like he probably does while causing harm and death to Floridians. This assumes he has teeth, which is not publicly apparent.

    And, announce his pick for Vice President now, Ginni!  DeSantis-Ginni 2024.

    for such a poll would be that the Republicans would attack the prosecutors who brought the indictment.  Merrick Garland would need increased security.  Fulton County (Atlanta) DA Fani Willis is being attacked just for investigating Trump and are calling for her recall from office.  Not much chance for a successful petition let alone a recall, but it indicates the intimidation and chilling effect afoot.  And, Trump would find a way to grift on an indictment--- send money for my defense from the socialists and pedophiles out to get me.   Thee is No bottom.

    Republican Accountability PAC is paying for an ad to air on major channels to defeat Herschel Walker. In the ad,  Walker's ex-wife describes him placing a gun against her head threatening to blow her brains out.

    We just might increase the Dems majority in the Senate yet due to poor quality of Republican candidates.

    mentioned that the OK senate special election race with Kendra Horn has become competitive but I can't find any polling to back up that assertion.

    We may see a few surprises.

    There were quite a few Republicans here that said Walker is going to give up a possible senate seat. Obviously those republicans had no effect on the voting habits of GA GOP primary voters. Just my opinion but even if the GOP had nominated someone decent they still would have a problem beating Warnock. I would be a lot more worried if Ossoff was running & I think it's likely he won't make it past 1 term.

    but I'm not sure those democrats live in GA. Maybe it will help bring young people out to vote. But he's going to be running for reelection in Biden's 6th year which is usually notoriously bad for the president's party & he didn't get as many votes as Perdue in the first round in 2020. Perhaps GA will be a lot more blue in 4 years and none of these will be issues.

    I had always suspected that Kim Wexler would be brought back for an encore, and in the penultimate episode she certainly didn't disappoint. Rhea Seehorn's work as Kim tonight was emotionally devastating.

    What's left of Gene's / Saul's / Jimmy's post-"Breaking Bad" world in Omaha has suddenly crashed in on him. The harsh manner in which he was finally exposed by Marian, Jeff's elderly but still very protective mother, was epic.

    And now, thanks to her and Kim, even as Gene Takovic bolts from Marian's house and flees the scene, there's really nowhere for Saul Goodman to run and nowhere for Jimmy McGill to hide. All that's left for us to ponder is Jimmy's ultimate fate next week, and whether Kim goes down with him.

    The legendary Carol Burnett's role as Marian was certainly no cameo. Her performance was flawless, and that final confrontation between her and the equally brilliant Bob Odenkirk's Jimmy / Saul / Gene was every bit as suspenseful and harrowing as the tragic scene a few weeks ago when Lalo coldly dispatched the hapless Howard.

    The poll was so very apparent that it had been commissioned by the Oz campaign. It started out benign enough. And there were the basic demographic questions. But there was a series of about 8 questions with really bizarre claims about Fetterman with the question would it change my perception of him or chance of voting for him. I answered no to all the question. That my vote would not be swayed. I told the pollster Fetterman could shoot someone on Fifth Ave. and I would still vote for him. (I was being facetious.).

    Some of the other questions were kind of loaded as well and I couldn't answer them being so lopsided. It was still an interesting experience and I hope my answer to get into the statistics. (With the realization that Oz is doomed).

Fetterman's Pardons Board I can tell you that the two main categories of folks he is pushing to get out of our overcrowded prisons are: (1) marijuana cases; and (2) felony-murder defendants who have served over 15 years, that is, conspirators, look-outs and getaway drivers from robberies-gone-bad, who personally neither killed nor intended to kill anyone, but where someone died as a result of the robbery, be that a victim, a co-defendant or a bystander. Due to an old, unreformed statute, Pennsylvania (unlike most states) imposes life without parole for this offense, and we have hundreds of these guys in our prisons, some for many decades.

    Trump was stacking the deck.

    At one point it was suggested that he could endorse "Eric," and that by doing so he would be supporting both Schmitt and Greitens.

    It was a madcap exit ramp. But Trump went in on the details, asking if the two candidates' first names were spelled identically -- noting that it wouldn't work if they weren't. While Trump was intrigued, he also remarked that it might be too cute. He asked for draft endorsements to review, one announcing his support for Schmitt, the other for Greitens...

    ...But Trump circled back to the idea of endorsing the two Erics, reasoning that there were pluses and minuses to both, and that by doing so it would provide to each the opportunity to win with his support. He drafted a statement that would soon go out.

    There was a well-funded mayoral candidate in Honolulu two years ago whose campaign tag line in every commercial was "He'll bring people together to get things done." His ads played so often on TV that I heard from our neighbor's kid that his fellow dorm residents at the University of Hawaii-Manoa turned it into a drinking game. I don't know how true that is, because no doubt everyone would've been totally blitzed by 9:00 p.m. every night during election season if they did play it. Anyway, that candidate lost because ultimately, he was all meringue and no filling.

    I am in the tax department can't help on that one.  I refer you to the heath department that does say at six weeks, an embryo does not have a fully formed heart, just a cluster of cells that emits electrical signals---perhaps, the religion and morals department can assist you with blastocysts to zygotes to embryos during those first six weeks,and, then the day-count depends on.when you start counting, from the last period, or not.

    but the US Supreme Court has ruled that punitive damages in any state court may be subject to some sort of cap under the due process clause of the 14th Amendment. Under these precedents, punitives that are more than quadruple the actual damages are suspect under this provision, and any that exceed a single-digit multiplier (i.e., 9x) are presumptively excessive. So if the jury goes over, say, $15 mil in punitive damages where the jury has found the actual damages to be $4 mil, the judge may have to scale them back and if the jury goes over $35 mil, the judge will almost certainly have to. Without verifying, I see that some Texas lawyers' websites claim that punitives are limited by statutory law in that state (thanks to "tort reform," i.e., lobbying by insurance companies) to 2x the actual damages plus up to $750,000 for non-economic losses. But there may be some separate rule for defamation cases, or egregious conduct, or something else that applies here.

    the mode of "substantive due process" analysis used by the Supreme Court to limit punitive damages is very much like the mode of constitutional category-creating and line-drawing that the radical-conservative supermajority just derided as "egregiously wrong" in Dobbs, the abortion case. But application of the substantive due process doctrine to punitive damages mostly favors rich people, insurance companies and big corporations, so we will see if it is subject to the same "principled" attack as was launched against Roe v. Wade.

    This one in Nevada might be tougher to justify the use of force than the one involving NYC Bodega worker Jose Alba.  Warning the video is graphic.

    If charged, I would have a hard time voting to convict the owner but Nevada law makes it sound like the stabbing was excessive.  But what was he supposed to do?  A guy wearing a ski mask jumped over the counter to steal items.  Was the owner supposed to let him take whatever he wanted and hope he doesn't have a weapon that might be used against him?

    What does Nevada law say about the use of deadly force?  Is it limited to situations where it someone is: 1) facing imminent threat of seriously bodily harm or death or 2) in their home where someone else is committing a felony?

    Or are we at the point where we just get to assume someone grabbing vape cartridges is about to commit a violent assault using an imaginary weapon?  Seems an odd position for someone who claims to believe in facts, due process, etc.

    The stabee is not clearly seen in the video for his first several steps into the shop. At first the video is somewhat blurry of him and after that he's blocked from the camera's view by the other guy.

    So we cannot see his hands during that time.

    In my opinion, the video does not refute the owner's description of what he saw.

    if the owner is claiming he saw something before the start of the video there is no point in speculating on whether or not it actually happened. Under Nevada 'stand your ground' the mere fear of violence does not justify homicide. There must be a reasonable fear of imminent harm. The fact that he was robbed three times is irrelevant.
    BTW, sarcastic, why did you place the owners statement in quotes if he said 'something like?'
    There are two issues being conflated:
    1)was he morally justified in committing homicide
    2) was he legally justified
    As much as some would like to cheer on somebody who is mad as hell this homicide is not a movie or a joke.

It must appear that the circumstances were sufficient to excite the fears of a reasonable person and that the person killing really acted under the influence of those fears and not in a spirit of revenge.

    So the store owner allegedly gave an interview where he made some clearly self-serving claims that are completely unsupported by the video and that, even if true, have no bearing on whether he faced a threat of imminent serious harm or death when he used deadly force.  Just like your claim about the prior robberies are irrelevant and in no way support the user of deadly force.

    And so persuasive!  The guy who stabbed someone claiming the guy had his hand in a bag (nowhere in the video) and admits he could "only assume the worst" (i.e. assume someone had a deadly weapon with no evidence other than imagining it).  So deadly force is justified if we can't see someone's hands and we're imagining they have a gun.  or perhaps when someone has been (supposedly) robbed several times and just "had enough".  Actually, is there a threshold for the number of times that justifies deadly force?  This is all such good stuff they don't teach you in law school.

    the news story, the RICO part has no basis at all. The plaintiffs may have a state law consumer protection claim, but the federal judge could throw that out of federal court after dismissing the RICO part (for lack of standing). The plaintiffs allege they are consumers of MM in AK. How are they harmed by the existence of the MM program? And how are they benefited by ending it?     This is a private civil "consumer protection/ false advertising" case by three MM consumers (purporting to start a class action) claiming that MM they bought had a lower THC level than advertised. Then the suit (according to the news story) throws in a federal civil RICO claim that the entire MM industry is a "racketeering enterprise" as defined in that law. (In other words, no prosecutors have anything to do with it. It is not a criminal case.) How that is supposed to have harmed the plaintiffs or entitle them to money is a complete mystery to me. Nor can I see how the MM business being (supposedly) entirely illegal supports the plaintiffs' claim for a consumer protection remedy, where on their own theory they would be criminal participants in the "enterprise." I would expect any federal judge to throw the case out, possibly with sanctions imposed.

    When I watched the full video of the traffic stop, I saw a police officer who cared about people and was trying to do the right thing.  There was conflicting evidence about who was at fault and I don't expect police to be social workers or mind readers.
